Welcome to LITM (Love Is The Message). By accessing or using our platform (website and mobile applications), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

LITM is operated by LITM (Love Is The Message), based in New Jersey. These Terms constitute a legally binding agreement between you and LITM.

You must be at least 18 years of age to use LITM. By creating an account, you represent and warrant that you are 18 years of age or older. We verify age based on the date of birth you provide during registration.

To use LITM, you must create an account by providing:

• Your name
• Email address
• Password
• Date of birth
• Zip code
• Profile picture

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at admin@mylitm.com of any unauthorized use of your account.

The free version of LITM allows you to:

• View curated events in your city
• View "LITM approved" event recommendations
• Indicate whether you are attending events
• Receive event-related surveys via email

The paid version includes all free features plus:

• Ability to interact with other users attending the same events
• Enhanced community features
• Priority event recommendations

Subscriptions are billed monthly and can be canceled at any time. Cancellation will take effect at the end of the current billing period.

LITM curates and recommends events found online. Events are hosted by third-party organizers, not by LITM. When you click on an event, you will be directed to the third-party's registration or information page.

IMPORTANT: LITM IS NOT RESPONSIBLE FOR:

• The quality, safety, or accuracy of third-party events
• Event cancellations, changes, or postponements
• Actions or omissions of event organizers or other attendees
• Any injuries, losses, or damages that may occur at events
• Ticket prices, refunds, or registration issues with third-party platforms

By using LITM, you acknowledge that you attend events at your own risk. LITM serves solely as a discovery platform and makes no warranties regarding any events listed.

You agree to use LITM only for lawful purposes. You agree NOT to:

• Provide false information during registration
• Impersonate any person or entity
• Harass, abuse, or harm other users
• Post or transmit any offensive, inappropriate, or illegal content
• Use the platform for commercial solicitation without permission
• Attempt to gain unauthorized access to our systems
• Violate any applicable laws or regulations

If you encounter inappropriate behavior from other users or experience issues at an event, please report it immediately to admin@mylitm.com. We take user safety seriously and will investigate all reports.

You may also recommend events for LITM approval by emailing admin@mylitm.com.

Paid subscriptions are billed monthly at $9.99 per month. Payment will be charged to your Apple App Store or Google Play Store account. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period.

All subscription fees are non-refundable except as required by law. If you believe you were charged in error, please contact admin@mylitm.com within 30 days of the charge.

All content on LITM, including but not limited to text, graphics, logos, images, and software, is the property of LITM or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reproduce any content without our express written permission.

Your privacy is important to us. Please review our Privacy Policy (below) to understand how we collect, use, and protect your information.

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any other reason at our sole discretion. Upon termination, your right to use LITM will immediately cease.

You may terminate your account at any time by contacting admin@mylitm.com or through the app settings.

LITM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LITM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the service
• Any conduct or content of any third party on the service
• Attendance at any events listed on the platform
• Unauthorized access to or alteration of your data

IN NO EVENT SHALL LITM'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO LITM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS LESS.

You agree to indemnify, defend, and hold harmless LITM, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of LITM, your violation of these Terms, or your violation of any rights of another person or entity.

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions.

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of LITM shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

The arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will take place in New Jersey, or at another mutually agreed upon location.

YOU AND LITM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Either party may bring a lawsuit in court for:

• Injunctive relief to stop unauthorized use or abuse of the service
• Intellectual property infringement claims
• Claims that fall within small claims court jurisdiction

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a notice on our platform. Your continued use of LITM after changes are posted constitutes acceptance of the modified Terms.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

You may opt out of promotional emails by clicking the "unsubscribe" link in any marketing email or by contacting admin@mylitm.com. Please note that you will still receive transactional emails related to your account.
